Spanbuy Disclaimer

Scope of Application: This Disclaimer applies to all scenarios where users use Spanbuy's official website (https://spanbuy.com/) network services, cross-border logistics services (including warehousing, inspection, transportation, after-sales) and related auxiliary services. It is a supplementary clause to the Spanbuy Service Agreement and has the same legal effect as the Service Agreement.
Spanbuy (hereinafter referred to as "we") is committed to providing users with stable and compliant services. However, due to the particularity of network services and cross-border logistics, we clarify the scope of exemption for the following situations. Please be advised:
I. Disclaimer for Network Services
- Technical Failures and Interruptions: If official website access anomalies or function suspensions (such as failed order submission, delayed logistics tracking) occur due to force majeure or uncontrollable technical factors (e.g., network operator failures, server maintenance, system upgrades, hacker attacks, natural disasters like earthquakes or typhoons), we will make every effort to repair promptly but shall not be liable for direct or indirect losses caused thereby (e.g., product price fluctuations due to order delays, missed business opportunities).
- Cookies and Data Security: We use Cookies in accordance with the Spanbuy Cookie Notice. If users modify browser Cookie settings (e.g., disable strictly necessary Cookies) leading to service anomalies (such as inability to log in to accounts or save delivery addresses), or risks arising from virus infections on users' devices or Cookie data tampering by third-party software, users shall bear the responsibility themselves.
- Accuracy of Information: The logistics route timelines, shipping fee standards, and warehousing rules displayed on the official website are formulated based on current cooperative resources and policies. If information update delays occur due to adjustments by partners or changes in the policies of the destination country/region, we will correct them promptly upon discovery, but shall not be liable for losses caused by information deviations before correction (users can contact customer service to confirm the latest information before placing orders).
II. Disclaimer for Cross-Border Logistics Services
- Force Majeure and Policy Risks: If packages are detained, seized, returned, or destroyed due to customs inspection at the destination, customs clearance policy adjustments, trade controls, wars, epidemics, or other force majeure factors, we will assist users in providing documents required for customs clearance (e.g., commercial invoices, packing lists) but shall not be liable for compensation for package value losses, shipping fees, or warehousing fees.
- Responsibility for Goods and Packaging:
- If users ship prohibited items (see Spanbuy List of Prohibited Logistics Items), infringing goods, or goods that do not comply with the destination's laws and regulations (e.g., dangerous goods, counterfeit products), leading to package confiscation or penalties, users shall bear the relevant legal responsibilities and losses.
- We shall not be liable for compensation for goods damage caused by improper packaging by users (e.g., fragile items without buffer treatment, unsealed liquids) or disputes arising from inherent quality issues of goods (e.g., deterioration within the shelf life, functional failures), but can assist users in negotiating with logistics providers.
- Responsibility of Third-Party Logistics Providers: For issues caused by operational errors of third-party logistics providers (e.g., RM/DPD, air freight companies) entrusted by us (such as sorting errors, delivery delays), we will actively assist users in claiming against the logistics providers but shall not directly bear compensation liabilities (specific claim standards shall be subject to the logistics provider's terms and the Spanbuy Service Agreement).
- Scope of Inspection Services: The free inspection service we provide only includes "appearance integrity check and internal item quantity verification" and does not involve authenticity identification or functional testing of goods (e.g., power-on inspection of electronic products, ingredient testing of cosmetics). If users have further requirements for product quality, they shall entrust professional institutions for testing, and we shall not be liable for product issues beyond the scope of inspection.
III. Other Disclaimer Scenarios
- User Operational Errors: Users shall bear the responsibility for service delays or failure to realize rights caused by incorrect information filled in by users (e.g., incomplete delivery address, wrong mobile phone number), failure to check service notifications in a timely manner (e.g., overdue warehousing reminders, abnormal package notifications), or failure to submit after-sales materials in accordance with guidelines (e.g., failure to provide damage photos when claiming).
- Risks Associated with Third-Party Services: When users obtain services through third-party platforms linked from the official website (e.g., payment institutions, product purchasing websites), disputes arising from the rules or service issues of the third-party platforms (e.g., payment failures, inconsistent purchased products) have no connection with us, and users shall negotiate directly with the third parties.
- Disclaimer for Indirect Losses: Under no circumstances shall we be liable for users' indirect losses or expected interest losses, including but not limited to reputation losses, opportunity losses, and other business losses caused by service interruptions.
IV. Special Reminders
- Before using the services, users should carefully read this Disclaimer, the Spanbuy Service Agreement, and relevant rules. If users do not agree to the exemption clauses, they may choose not to use our services; continued use shall be deemed as recognition of all contents of this Disclaimer.
- If the contents of this Disclaimer conflict with mandatory provisions of laws and regulations, the provisions of laws and regulations shall prevail; for matters not stipulated herein, the Spanbuy Service Agreement and relevant industry standards shall apply.
