Spanbuy Service Agreement

This Spanbuy Service Agreement (hereinafter referred to as "this Agreement") is jointly entered into by you (hereinafter referred to as "User") and Spanbuy, the service provider (hereinafter referred to as "we/us"). It aims to define the rights and obligations of both parties in the use of Spanbuy's official website (https://spanbuy.com/) and related services (including account management, overseas purchasing assistance, logistics and warehousing, after-sales support, etc.). Please read this Agreement carefully before registering for or using the services. By clicking "Agree" or actually using the services, you are deemed to have fully understood and accepted all contents of this Agreement.
I. Scope and Description of Services
- Core Service Contents: We provide users with cross-border logistics-related services, including but not limited to:
- Warehousing for incoming goods (90-day free storage period; an overdue storage fee of 0.5 CNY per day per package will be charged after the free period);
- Inspection upon arrival at the warehouse (free appearance check, internal item quantity verification, and photo documentation);
- Multi-route logistics delivery (air freight, China-UK Railway, Card Railway RM/DPD, small package/oversized special line sea freight, etc.);
- Order status tracking and after-sales assistance (including lost package claims, abnormal issue handling).
- Service Restrictions:
- The services are only available to natural persons with full capacity for civil conduct or legally registered enterprises/organizations; minors must use the services under the accompaniment of a guardian.
- Transporting prohibited items (such as flammable and explosive materials, controlled knives, infringing goods, etc.) via the services is prohibited. Users must ensure that the goods to be shipped comply with the laws and regulations of China and the destination country/region.
II. User's Rights and Obligations
(I) User's Rights
- Legally register and use a Spanbuy account, and inquire about account information, order status, and logistics tracking.
- Enjoy free or paid services as stipulated in this Agreement, and put forward suggestions or objections regarding service quality.
- Apply for after-sales services if eligible (e.g., lost package claims: 50 CNY per kg + shipping fee refund for air freight, 1.5x shipping fee refund for oversized sea freight, etc., subject to the provisions of the selected logistics route).
- Exercise rights such as access, correction, and deletion of personal information in accordance with the Spanbuy Privacy Policy.
(II) User's Obligations
- Provide true and accurate information (such as mobile phone number, email address, delivery address, etc.) during registration, and update the information in a timely manner if there is any change. The User shall bear the responsibility for any service abnormalities caused by false or outdated information.
- Properly keep account credentials such as passwords and verification codes. The User shall bear the losses caused by account theft or password leakage (except for losses caused by our system vulnerabilities).
- Abide by this Agreement and the rules published on the platform (e.g., List of Prohibited Items for Logistics Transport), and shall not use the services for illegal or non-compliant activities (such as fraud, smuggling, infringing on others' rights and interests, etc.).
- Pay service-related fees (such as overdue storage fees, logistics shipping fees, etc.). The fee standards shall be subject to the order checkout page or the official announcement on the website. We have the right to suspend services until the fees are settled if payment is overdue.
III. Our Rights and Obligations
(I) Our Rights
- Review User registration information in accordance with laws, regulations, and this Agreement, and take measures such as restricting account use or canceling accounts for non-compliant accounts.
- Make reasonable adjustments to service contents and fee standards. We will notify Users of such adjustments via pop-up windows on the official website, SMS, or email in advance. Continued use of the services by the User shall be deemed as acceptance of the adjusted contents.
- If services cannot be normally provided due to force majeure (such as natural disasters, policy adjustments, temporary suspension of logistics channels) or User reasons (such as incorrect address, refusal to accept goods), we have the right to suspend or terminate the services without assuming liability for breach of contract.
(II) Our Obligations
- Provide stable and compliant services in accordance with the provisions of this Agreement, establish a service quality assurance mechanism, and promptly respond to User inquiries (Service Hotline: +8615880115921; Service Email: spanbuy@126.com; responses will be provided within 10:00-18:00 on working days).
- Protect Users' personal information in accordance with the Spanbuy Privacy Policy, and shall not disclose or sell User information (except as required by laws and regulations or authorized by Users).
- Conduct basic inspection on goods arriving at the warehouse, and promptly notify the User and assist in handling if abnormalities (such as damaged packaging, missing internal items) are found.
- Provide logistics tracking services. After the goods are shipped, the logistics tracking number and inquiry link will be synchronized to ensure that the User can know the transportation progress in real time.
IV. Order and Payment Rules
- Order Generation: An order is officially generated after the User submits the order on the platform and confirms the information (product information, delivery address, logistics route, etc.). Once generated, the order cannot be modified at will; if adjustments are needed, the User shall contact customer service for assistance.
- Payment Requirements: The User shall complete the payment (including product purchasing fees , logistics shipping fees, estimated taxes and fees, etc.) within 24 hours after the order is generated. Orders with overdue payment will be automatically canceled.
- Handling of Payment Abnormalities: If the order still shows "Pending Payment" after payment, the User shall keep the payment certificate (such as screenshots, transaction records) and contact customer service for verification. We will conduct an investigation and handle the issue within 1-3 working days.
V. After-Sales and Claim Rules
- Objections to Inspection: The User shall raise objections within 3 days after receiving the inspection report. Failure to raise objections within the time limit shall be deemed as acceptance of the inspection results, and no further disputes regarding the inspection will be accepted thereafter.
- Lost Package Claims: If a package is confirmed lost during logistics transportation, the User shall submit a claim application (with order number and logistics tracking number attached) within 7 days after the loss is confirmed. We will review the application within 5 working days and make compensation in accordance with the route standards if the application is eligible.
- Damage Claims: If goods are damaged due to logistics reasons, the User shall provide evidence such as photos of the damage and logistics records. After verification, compensation will be negotiated based on the actual value of the goods (subject to the purchase certificate), with the maximum amount not exceeding the claim limit of the corresponding route.
- Situations Not Covered by Claims: We shall not be liable for losses caused by the inherent quality of the goods, improper packaging by the User, force majeure, or customs policies of the destination country/region.
VI. Modification and Termination of the Agreement
- Modification of the Agreement: We may update this Agreement in accordance with changes in laws and regulations or business adjustments. After the update, the Agreement will be published on the official website. Continued use of the services by the User shall be deemed as acceptance of the updated Agreement. If the User does not accept the update, the User may apply for account cancellation and stop using the services.
- Termination of the Agreement:
- If the User actively applies for account cancellation and has no pending orders or unpaid fees, we will complete the cancellation within 10 working days.
- If the User violates the provisions of this Agreement (such as transporting prohibited items, committing fraud), we have the right to unilaterally terminate the services and cancel the account without refunding the paid fees.
- If the services can no longer be provided due to legal and regulatory requirements or force majeure, this Agreement will be automatically terminated, and we will refund the fees paid by the User but not yet used (such as unused logistics fees, remaining storage fees).
VII. Disclaimer
- If services are temporarily interrupted due to network failures, system maintenance, or abnormalities of third-party services (such as failures of payment platforms or logistics companies), we will make every effort to repair the issue but shall not be liable for direct or indirect losses caused thereby.
- The User shall bear the losses caused by operational errors (such as incorrect address filling, failure to check notifications in a timely manner), misunderstandings of the services, or personal device problems.
- The User shall bear the delays or additional fees caused by customs inspection, tax adjustments, or policy changes in the destination country/region. We may provide necessary assistance (such as providing documents required for customs clearance).
VIII. Dispute Resolution
- Disputes arising between the two parties due to this Agreement shall first be resolved through friendly negotiation. If negotiation fails, either party may file a lawsuit with the people's court with jurisdiction in the place where we are located.
- The formation, effectiveness, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China (excluding the laws of Hong Kong, Macao, and Taiwan regions).
IX. Others
- This Agreement is a supplement to the Spanbuy Privacy Policy. In case of any inconsistency between the two, this Agreement shall prevail; for matters not stipulated herein, the Spanbuy Privacy Policy and other platform rules shall apply.
- If any clause of this Agreement is deemed invalid or unenforceable, it shall not affect the validity of other clauses.
